Richman Greer Secures Major Litigation Wins for Corporate Clients

Richman Greer attorneys continue to successfully represent major corporations in complex litigation matters.

Mark A. Romance, Eric M. Sodhi and Joshua L. Spoont successfully defended a Fortune 100 Company in a significant product liability claim surrounding the use of a building material in construction of a Miami Beach condo building. Beyond the significance of this win for the client, the court ruling helped protect the integrity of Florida’s economic loss rule, which has undergone significant erosion during the past three years.

Here is the background: The building in question was constructed using a fire safety product that allegedly caused leaks in the building’s fire sprinkler system. The Akoya condominium association filed suit against the Fortune 100 company seeking damages to replace the entire fire sprinkler system and for costs associated with repairs previously made to the building. Mr. Romance, Mr. Sodhi and Mr. Spoont successfully obtained a summary judgment in favor of the client in 2015. The trial court entered an extensive written order and ruled that Florida’s “Economic Loss Rule” bars the condo association from recovering the damages sought, and entered final judgment in favor of the company. The three attorneys then represented the company in the appeal. On September 7, the appellate court affirmed the judgment in favor of the client. The condo association then requested that the Florida Supreme Court review the case, a request which was denied by the Supreme Court.

This outcome has significant implications for Florida’s economic loss rule, which has undergone significant changes in Florida in the past three years. Specifically, the rule provides that a claimant cannot recover damages in tort for purely economic losses, but rather, the remedy, if any, is limited to contract principles. The rule has recently been eroded to only a few circumstances, and the condo association in this case sought to further erode the rule to allow claims for damages by condo owners against product manufacturers. The appellate court in this case re-affirmed that the economic loss rule applies to bar claims for damages arising out of a product that is incorporated into a building during construction, even though the condo association would have no direct claim against the company that manufactured the allegedly defective product.

Another example of our firm’s recent wins concerns my representation of our longtime client DIRECTV LLC in a class action brought by Shehan Wijesinha for alleged violations of the Telephone Consumer Protection Act of 1991. After briefing, the court entered an order granting DIRECTV LLC’s Motion to Compel Arbitration.
